WAIVER AND RELEASE OF LIABILITY AND ASSUMPTION OF RISKS

For Participants UNDER THE AGE OF 18 for all Activities on the Real Property located at 25445 Wrightwood Drive, Idyllwild, CA 92549

This document contains a waiver of your legal rights and a release of all claims for any loss, damages, personal injury or death. Please read and consider it carefully before signing below.

I, , hereby certify that I am the adult parent or guardian of , a minor child under the age of eighteen years, and hereby acknowledge and agree that I have asked to reside as a visitor and use all of the facilities located on the real property commonly known as 25445 Wrightwood Drive, Idyllwild, CA 92549. I hereby agree to the following for each and every day which I may be on the real property commonly known as 25445 Wrightwood Drive, Idyllwild, CA 92549 (hereinafter referred to as the “Idyllwild Property”).

IN CONSIDERATION of being allowed to reside as a visitor at the Idyllwild Property and use any and all of the facilities on the Idyllwild Property, I acknowledge, appreciate, and agree that:

1. I hereby knowingly and voluntarily agree to assume all risks, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE of those persons released from liability below, related to my use of the residence and facilities located at the Idyllwild Property, and I agree for myself and on behalf of my heirs, guardians, legal and personal representatives and assigns to make no claim against, sue, or otherwise prosecute the owners of the Idyllwild Property (which owners are currently JOAQUIN L. PEREZ and JENNIFER L. BERMUDEZ-PEREZ), and any of their respective agents, heirs, successors, or assigns (hereinafter referred to as “Released Parties”) for any loss, injury, damages, or death resulting from negligence or any other cause related in any way to my use of the residence and facilities located at the Idyllwild Property, or any action at or related to the above referenced real property.

2. I hereby release and forever discharge the Released Parties from all liability, actions, claims, and demands for myself and on behalf of my heirs, guardians, assigns, legal and personal representatives, that may hereafter exist for any loss, injury, property damage or death, whether from negligence or howsoever caused, related in any manner to my use of the residence and facilities located at the Idyllwild Property, or any action at or related to the above referenced real property.

3. I further agree that this Waiver and Release is intended to be as broad and inclusive as is permitted by law and that if any portion hereof is held invalid, the balance shall continue in full legal force and effect. I agree to comply with all of the rules and regulations, as specified by the Released Parties, which are intended to promote, but in no way guaranty, the safety of the use of the facilities located on the Idyllwild Property.

4. I understand that the Released Parties do not guarantee my safety, or the conduct and safety of other residents/participants, nor do the owners of the Idyllwild Property assume responsibility for the actions of any other resident/participant.

5. The Released Parties do not provide medical insurance. I agree to provide my own medical insurance. The Released Parties do NOT make any guaranty, warranty, or representation with regard to the availability or quality of any emergency or medical treatment, equipment, or personnel at the Idyllwild Property. I understand that it is my responsibility to determine whether I want to reside and use the facilities located at the Idyllwild Property, after I have determined through my own investigation at the Idyllwild Property what emergency or medical treatment, equipment, or personnel are available at the Idyllwild Property.

6. I understand that my use of the residence and facilities located at the Idyllwild Property are conditioned and contingent upon my agreement to all of the terms set forth in this document. I agree to participate at my own risk and I will hold the Released Parties harmless for injury, death or damages sustained as a result of my participation.

7. This document contains and embodies the final understanding between me and the Released Parties regarding my use of the residence and facilities located at the Idyllwild Property, and it supersedes any and all prior, contemporaneous, or other representations, understandings, or agreements. Unless set forth in a subsequent document signed in writing by me and the Released Parties, any representations, understandings, or agreements related to my use of the residence and facilities located at the Idyllwild Property.

8. I understand that the Released Parties cannot guaranty the safe behavior of other participants or that the other participants will always follow all of the rules designed to promote safety at the Idyllwild Property. Even though the Released Parties may try to enforce certain safety rules for the benefits of all participants, I am not relying on the Released Parties to enforce any rules or requirements, and I understand that my waiver and release of all claims against the Released Parties above includes any claims related to enforcement of rules at the event or Facility.

9. I the parent/guardian signing this document represent that I have legal authority to (1) sign this Waiver and Release on behalf of the participant and (2) waive the participant’s legal rights in accordance with the terms of this document. I agree that this Waiver and Release will continue in full force and effect and shall apply to all of the participant’s future visits. I further acknowledge that my signature below is made voluntarily, after having an opportunity to inspect the facilities located at the Idyllwild Property, and consider my alternatives, which include not residing at or using the facilities located at the Idyllwild Property. I agree that any lawsuits related to this Waiver and Release or the facility shall be filed, and exclusively litigated, in Riverside County, California.

I HAVE CAREFULLY READ THIS DOCUMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT (1) THIS DOCUMENT IS A COVENANT NOT TO SUE AND RELEASE OF LIABILITY REGARDLESS OF NEGLIGENCE OR FAULT AND IS A CONTRACT BETWEEN MYSELF AND THE RELEASED PARTIES FOR THE BENEFIT OF THE RELEASED PARTIES. I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, AND I ACKNOWLEDGE VOLUNTARILY AGREEING TO AND SIGNING THIS THREE PAGE DOCUMENT.
